Fair Use

Under the fair use guidelines, you can copy a portion of copyrighted work without copyright infringement. The general guidelines below explain what can be reproduced under the fair use provision.

  • You must be using your copies for a nonprofit, educational purpose.
  • The time at which you were inspired to use the copyrighted work and the time at which you will use it are too close for a permission request to be processed.

Rules for using differnt kinds of copyrighted work:

  • Poetry—no more than 250 words or 2 pages.
  • Prose—a complete article, story, or essay is allowed under 2,500 words, or if the work is longer, 10% or up to a maximum of 1,000 words.
  • Illustrations—one chart, diagram, drawing, graph, cartoon, or picture per book or per periodical issue.
  • Special Works—(works that combine text with illustrations such as children's books or poetry) no more than 10% of the words in the text may be used without permission. Making multiple copies for classroom use within the fair use guidelines contains some prohibitions.
  • Copies cannot be from an anthology or be used to substitute or create one. If you wish to do this, you will need permission.
  • Copies of a consumable nature (i.e., workbooks, exercises, standardized tests, etc.) are not permitted.
  • Copies must not substitute for the purchase of books, publisher’s reprints, or periodicals.
  • Copies must not be directed by a higher authority, such as a dean or head of a department.
  • The same instructor cannot copy the same item without permission from term to term.
